Independent Mental Capacity Assessments


Jack is an experienced, independent mental capacity assessor and has been involved in the application of the principles of the Mental Capacity Act 2005 in capacity assessments since 2010 in the legal sector and for the Office of the Public Guardian and Court of Protection.

Deputy/
attorneyship visiting
& reporting service

Jack is an experienced Court of Protection Visitor (appointed by the Lord Chancellor under the rules set by the Commissioner for Public Appointments).

The visit reports Jack produces are aligned with the standards the OPG sets for professional and public authority deputies and cover key aspects that are found in the Court and the OPG’s section 58 reports.

If your case requires a less comprehensive approach, a short-form visit report can also be requested which conforms to a welfare check.

MCA compliance training & consultancy

Bespoke service typically for deputies, attorneys, Court of Protection teams and Public Authority deputyship teams on complying with Fiduciary duties, MCA & OPG standards.

Jack has long-standing experience as a Court of Protection Visitor (appointed by the Lord Chancellor under the rules set by the Commissioner for Public Appointments) and conducts compliance visits (assurance visits) to law firms and public authorities for the OPG.

Jack has also been involved in delivering the OPG’s assurance visit training to all the Court of Protection General visitors in England & Wales. In his time at the Law Society of England and Wales, Jack was also involved in risk and compliance training when the SRA’s new continuing competence rules and codes for firms and individuals were rolled out.

Property & financial affairs coaching (5 Steps)

Financial literacy coaching service (property & affairs) for people who may lack mental capacity.

Bespoke coaching service combines the complementary disciplines of a highly experienced and qualified special needs teacher and coach/mentor, Leon Carter, and highly experienced mental capacity assessor and publicly appointed Court of Protection Visitor, Jack Dunkley.

Coaching can cover 5 levels (5 Steps) of decision making that are relevant within most people’s lives, including personal spending, balancing income & expenditure, financial safety, savings & investments and family & legacy. Pervading each step will be coaching on concepts and principles around sound decision making. As well as enhancing the protected person’s ability to participate more fully, the coaching is tailored to ensure that deputies and attorneys adhere to supported decision-making duties to avoid breaches of compliance in OPG standards, MCA (section 4(4) and UN conventions for people with disabilities.
